Most medical care goes well. When it does not, and a patient is hurt because a provider failed to meet the standard of care, Washington law gives the patient a claim. These cases turn on medical evidence and take real resources to bring. Corey M. Kane represents patients and families in medical negligence cases throughout Washington State from Lacy Kane & Kube, P.S. in East Wenatchee.
What a patient must prove
A patient generally must show that the doctor, nurse, hospital, or other provider failed to use the care a reasonably prudent provider would have used in the same situation, and that the failure caused the injury. In most cases that takes testimony from a qualified medical expert. A bad result, by itself, is not malpractice.
Informed consent
Washington also allows a claim when a provider failed to tell the patient about a material risk of a treatment, the patient would not have agreed to it if told, and that risk caused the injury.

Deadlines
Medical negligence claims have strict filing deadlines, and some begin to run when the injury is discovered rather than when the care happened. If you suspect something went wrong, request your medical records and talk to a lawyer as soon as you can.
